Thoughts on "File Sharing" and the Tangled Issue of Copyright and Patent

AJ asks: What’s your opinion on the morality of sites like The Pirate Bay, and the various torrent sites, torrent clients, and file sharing and P2P in general? Do you consider downloading an mp3 for free the same as stealing? Metallica does. Do you agree with Metallica when they took on Napster? Yes, it stealing. The phrase “sharing” is outrageous. How bout I come break into your house and share some of your property, eh? My brother is a musician, and he hates this crap. But it’s the industry’s fault. They have so overpriced CD’s and movie tickets that no one wants to go to the movies or buy a CD. Forget concerts. Plus the scum keep phasing out tech and introducing it again. I owned 8-tracks, cassettes, albums and now CD’s. Theoretically, one could have bought the same work 4 different times as each old tech was phased out. It’s all a joke to get us to pay up to four times for the same work of art! Keep in mind that every time the bastards upgraded the media, the upgraded the devices to play the media. The jerks made me shell out for an 8-track player, a cassette player, a record player and now a CD player. No doubt they have further upgrades in mind down the road! However, there is a sell it or give it away problem here. Are the various TV shows for sale? What about shows that will never run again and yet are not being offered for sale. Ok, look, we ought to have a right to “steal” that stuff. There is a principle in copyright law that says, “Sell it or give it away.” You simply may not produce a work of art or any patented invention and then put it in your drawer and not let the public use it. For copyright, you may not release something and then pull distribution. People have a right to your art. If you don’t want to sell your art, then give it away. The same applies or ought to apply to software. Sell it or give it away. The very notion that abandonware exists is outrageous. I can’t tell you how many IT scum have defended the notion of abandonware to me. Capitalists in general are loathsome ratfucks anyway, but I must say that some of the filthiest, most evil capitalists I have ever met worked in the software industry. We can thank these maggots for totally unenforceable “software licenses” (Ever read one of those outrageous things?), software that miraculously comes out without an install disk, the total failure of the notion of customer service, forced upgrades, refusal to work with competitor’s products, and a pile of stinking horseshit as high as the stratosphere. It is because of the antics of the likes of Bill Gates et al that software went free and open source – consumers were so outraged by the industry’s crap that they killed the industry by producing their own free product. Some day the software industry will be a tiny shadow of its former self, and that will be a great day indeed. Bill Gates needs to have a stake driven through his heart in cemetery at midnight, but hold your cross in front of you to blind him so he doesn’t fight back. You also may not patent an invention and then refuse to release it to the public. If you don’t sell it, you must give it away. No hoarding of the public commons. The music industry is about as maggoty as the software scum, but musicians themselves are good people who surely deserve the fruits of their labors.

    The difference is that I couldn’t then use the stuff you were sharing. Downloading is copying, and no one’s stuff is denied them.
    Only thing being stolen is the right to withhold music from people who don’t pay the fee.

  2. Seems technology is “obsoletizing” creative monopoly. I suppose I can stamp the copyright symbol all over the shit I write on my blog and laugh at the futility.
    What’s up with this Blu-Ray garbage??? Seems like nothing new, just reworked existing money-making endeavors by entrenched firms seeking to make money off new laser colors. LOL!

  3. I don’t really see the point in file sharing of mp3’s.
    You can just search for the music video on YouTube and download it in mp3 format with software like Videoget which is much either and quicker.

    CD player, shit Robert mp3’s have been out for years and not that expensive.
    They are much smaller and store more music in the order you want and it wont skip like a CD if you are exercising while listening to it.

You can download full albums, and full works of various artists and bands from bitTorrent. I did it all the time when I had a PC. Youtube for mp3’s!? WTF! That is soooo not quicker. uTorrent is a great torrent client too. Why would anyone pay for mp3s now when you can just download them for free!

    1. Risk of getting caught is zero.
      Plus only a few good songs are good on any album the rest is shit.
      The Red Hot Chili Peppers have only had 3 good songs their entire career.
      When I used torrents I found them slow most of the times but that was TV and films rarely did I download music.
      How long did it take you to download an album?

  6. Thank you Lindsay. I always felt that there was a conspiracy in the high tech industry. It seems that high tech companies come up with a new slightly upgraded model every year and everyone feels they have to get the newest thing to be with the “in” crowd. So many kids get duped into this shit.

    With numbers of camp survivors going up each year, we tend to forget we are talking about death camps. There were few survivors and most of them died immediately after the war. Those alive were found dying and couldn’t be saved, and most of them weren’t Jews but rather Russians, Gypsies, Communists, trade unionists and anti-Fascists.
    Look at the numbers. There were only 5.3 million Jews listed as living in Europe, outside the USSR, in 1940. In a rough average, 12 death camps, filled to the brim with gas chambers and crematoriums ran 24 hours a day for 1000 days. Some are said, in testimony of literally thousands, to have killed from 17,000 to 20,000 per day. Lets use the figure, 10,000 per day times 12 camps times 1000 days.
    Where do a million survivors come from? I can see a thousand, ten thousand but not 30,000 and certainly not the 15 million necessary to justify the current number of claimed survivors according to typical actuarial tables for healthy adults of the period, those who were not starved and tortured for years. Look at Vietnam veterans. Only 700,000 of 2.9 million survive 35 years after the war. Something is wrong here.”

  8. johnUK, my downloads were really quick. A full album took a few minutes. Getting caught?! Nobody gets caught, LOL! As for you later post, so are you a Holocaust denier? Did Hitler seek to exterminate the Slavs, gypsies, and Jews? Or did he not?

      There have been cases her in Britain were people have been caught a fined. Chances may be slim but I wouldn’t want to take the risk.

      Actually the article does not deny the Holocaust but questions the fact that there is an unusually large number of survivors just like former Jewish Professor Norman Finkelstein did his book The Holocaust Industry and he doesn’t deny the Holocaust.

  9. LOL. Usual cover all bases answer from Robert. I’m for free music because it benefits ME. I’m not a musician and I really couldn’t care less that I don’t or do support musicians. There’s a Pacific, Atlantic, Indian, etc ocean of music already created and written “out there”. More than a lifetime spent stealing and listening could even scratch. So creativity in music means oh so little to me as a consumer. Creativity in music is only an abstraction anyway. Download, pirate, and consume!

  10. Again, you conflate Capitalism with State enforcement of creation-monopoly. Copyright is incompatible with Capitalism. Copyright gives a content creator the right to control the property of others by not allowing them to reproduce legally purchased content with THEIR property.
    Intellectual Property (IP) is a propaganda term for what used to be called Monopoly Privilege in the monarchical times. You can’t own ideas.
